In this CLE course we’ll review some of the biggest challenges that law firms encounter with respect to the issue of negotiating and resolving health insurance liens in single event cases. We’ll review practical problems with associated case law, we’ll discuss the ethics of outsourcing lien resolution to third party specialists, and we’ll focus on areas of rapid development about which attorneys need to be aware (including state laws regarding affirmative action in investigating liens, the forthcoming Medicaid Secondary Payer Act, review of the effect of the McCutchen case for ERISA plans, and developments in the treatment and handling of Medicare Advantage liens). Practice tips will be discussed to aid attorneys in overcoming many of the challenges discussed.
